What is the residency requirement for employment in the State of New Jersey?

May 2011 Governor Christie signed into law the New Jersey First Act (New Jersey Senate Bill No. 1730).  The law became effective September 1, 2011 and mandates that public employees obtain a principal residence in the State of New Jersey within one year of beginning their public employment.  The principal residency requirement applies to all regular and temporary employees, unless otherwise exempt.  The law defines principal residency as: (1) where the individual spends the majority of his or her nonworking time, (2) the location which is most clearly the center of his or her domestic life, and (3) the location which is designated as his or her legal address and legal residence for voting.  As a New Jersey public employer, new employees will be required to establish principal residency in the State of New Jersey within 365 days from the date of hire unless otherwise exempt.  For more information on the law visit: http://www.njleg.state.nj.us/2010/Bills/PL11/70_.PDF.

If I am offered employment at the college will I be required to live in the State of New Jersey?

As an employee of Essex County College, you will be required to abide by the New Jersey State residency requirement and maintain principal residency in the State of New Jersey for the duration of your employment with the college unless otherwise exempt.  If you reside outside of the state upon hire, you will have 365 days from the effective date of hire to establish principal residency in New Jersey.  If you fail to satisfy the principal residency requirement, you shall be deemed unqualified to maintain your position and employment with the College.  Detail information on the residency requirement for employment at the College is available at: NJ First Act.  Appeal for exemption from the residency requirement on the basis of critical need or hardship may be filed with:

If I am currently employed by the college and live outside of the State of New Jersey, will I be required to relocate to New Jersey?

Any employee living outside New Jersey on the effective date of the law, September 1, 2011, is exempt (‘grandfathered in’) from the residency requirement as long as the employee maintains continuous employment at the College without a seven (7) day break in service.  As an exempt (‘grandfathered in’) employee, you are not required to relocate to the State of New Jersey.  You may move within the State of your current residence or to another state without jeopardizing your position and employment with the College.  Detail information on the residency requirement for employment at the College is available at: NJ First Act.

If I am currently employed by the college will I be restricted from relocating to a state other than the State of New Jersey?

As an employee of the College, you are required to abide by the New Jersey State residency requirement and maintain principal residency in the State of New Jersey for the duration of your employment with the college.  Any employee, not otherwise exempt, who relocates outside of the State of New Jersey after September 1, 2011 shall be deemed unqualified to maintain their position and employment with the College.  To ensure compliance to the state residency requirement, the College cannot accept the use of a post office box (P.O. Box) as the main address of principal residence.  A post office box (P.O. Box) may be used as a mailing address, but not for the principal residence.

What is the consequence if one does not satisfy the residency requirement?

What is the process once I apply for a position?

Upon receipt, the Human Resources Department will review each application and forward the applications satisfying the preliminary screening criteria to the designated Areas and/or Departments of the College. A letter acknowledging receipt of the applicant’s submission is then forwarded to the individual applicant within three (3) to four (4) weeks from the time of submission.

Do you post part-time job vacancies?

The Human Resources Department is normally not involved in the recruitment efforts of the hiring departments with regard to part-time employment opportunities. To obtain information on the availability of part-time opportunities, you will need to the department of interest directly.

Do you offer any teaching opportunities for a Bachelor’s professional licensure or certificate degree holders?

While you are not eligible for a Faculty position or an Adjunct Faculty assignment in the credit programs, you may be eligible for Adjunct Faculty and Temporary assignments with our non-credit programs in the Community and Continuing Education Division.

Will I be required to have my academic credentials (e.g., transcripts) evaluated for acceptance since I obtained my education outside of the United States?

Academic credentials for education taken outside of the United States must be evaluated for United States of America equivalency by one of the following recognized agencies:
